A Jewish student at Columbia University in New York City has filed a class action lawsuit against the learning institution, claiming that it failed to provide a safe environment for its students. The student is seeking an emergency injunction to enforce the university’s ethical conduct and code of conduct to ensure a safe and secure learning environment free from harassment and discrimination. The lawsuit acknowledges the importance of spirited debate on college campuses but argues that when debates turn violent and hostile, genuine debate becomes impossible.

The lawsuit cites the events following an attack by Hamas-led terrorists on Israel on Oct. 7, which led to hostile debates on campus due to a humanitarian crisis in Gaza, Israel’s military response, and U.S. support for Israel. The lawsuit alleges that while freedom of speech is important, there is a subset of protesters who have engaged in acts of violence, intimidation, and harassment against Jewish students and faculty members. The protesters have been accused of inciting hate speech and violence, including calling for terrorist attacks against the United States and Israel, disrupting the normal functioning of the university.

The lawsuit details an incident on April 18 when extreme demonstrators at Columbia University created a “Liberated Zone” where over 60 tents were erected. Jewish students were allegedly blocked from walking through the area as anti-Israel activists used force, harassment, and threats of violence. University officials called for the removal of the encampment, but the protesters refused, leading to continuous harassment of Jewish students who were targeted with hate speech, physical violence, and discrimination. Massive banners and signs displayed anti-Semitic messages and messages in support of Hamas.

Despite calls from the university president for the encampment to be removed or face police action, the protesters refused to leave. The university then switched to a hybrid learning model for the semester, allowing students who felt unsafe to attend classes remotely. The lawsuit argues that this shift creates a two-tiered educational experience for Jewish and non-Jewish students, with Jewish students being relegated to online classes and stripped of meaningful interactions with peers and faculty. The plaintiff claims that this segregation of Jewish students is a dangerous development that could lead to more severe acts of violence and discrimination.

The student claims that the encampment negatively impacted her education when she was unable to turn in part of her final exam project due to safety concerns on campus. The lawsuit seeks injunctive relief, compensatory and punitive damages, attorneys’ fees, and other litigation expenses to hold the university accountable for failing to provide a safe educational environment for its students. Columbia University declined to comment on the lawsuit, which highlights the ongoing tensions on college campuses regarding free speech, safety, and support for marginalized communities.
