The Georgia Appeals Court has agreed to hear Donald Trump’s request to disqualify Fulton County District Attorney Fani Willis from his criminal election interference case. This decision comes after Fulton County Superior Court Judge Scott McAfee refused to remove Willis from the case despite the revelation that she was in a romantic relationship with a member of her legal team. Trump is facing charges of illegal attempts to overturn his loss to President Joe Biden in Georgia’s 2020 election, although no trial date has been set yet. Trump’s attorney, Steve Sadow, stated that the former president is eager to explain to the appeals court why the case should be dismissed and why Willis should be disqualified due to her alleged misconduct in what he calls a politically motivated persecution.

The Georgia Court of Appeals taking up Trump’s bid to disqualify his prosecutor is seen as a setback for Willis’ case against the presumptive Republican presidential nominee. Special prosecutor Nathan Wade recently stepped down from the prosecution after McAfee determined that either he or the D.A. must remove themselves from the case. This ruling followed a hearing on whether Willis should be disqualified for dating Wade while the case was under investigation. Both Willis and Wade testified that their romantic involvement began after Wade joined the prosecution team. McAfee further dismissed six counts in the case, including three against Trump, ruling that they were not sufficiently justified in the indictment. Nevertheless, Trump still faces 10 criminal counts in Willis’ case.

Despite the recent developments, the D.A.’s office declined to comment on the appeals court’s decision to allow Trump’s appeal of McAfee’s ruling to disqualify Willis. The appeals court has granted Trump’s application to appeal while Willis’ case is still ongoing, giving him 10 days to file the notice of appeal. The outcome of this appeal could potentially alter the course of the criminal case against Trump and the involvement of District Attorney Fani Willis.
