Kouri Richins, a Utah mother accused of spiking her husband’s cocktail with fentanyl, recently made comments from jail expressing her frustration with her situation. She criticized prosecutors, asserted her innocence, and lamented the forced upheaval in her case. Richins has been held in the Summit County Jail for over a year without bail. Her lead attorney requested to withdraw from her defense against charges of aggravated murder in the death of her husband, Eric Richins, on March 4, 2022. Her defense team cited an irreconcilable situation as the reason for their withdrawal.

Richins stated in one of her jailhouse statements that she was devastated by her defense team’s withdrawal, emphasizing that it was not her choice. Her lawyers had also requested to disqualify prosecutors over alleged severe violations that compromised their defense and infringed on her constitutional right to effective counsel. It was revealed that authorities had recorded jail calls between Richins and her lawyers without their consent. Prosecutors were accused of prolonging the process and engaging in corrupt behavior to hide their actions.

The defense team discovered the practice of recording calls and raised concerns with prosecutors, who initially denied knowledge of it. However, it was later revealed that they had been recording calls for six months and provided the lawyers with the recorded calls through discovery. Richins accused prosecutors of unconstitutional behavior and stated that she was eager to prove her innocence at trial. Prosecutors have disputed the allegations made by the defense team, claiming that the motion to disqualify them was inaccurate and filed in bad faith.

Prosecutors have alleged that Richins was deep in debt and fraudulently obtained a substantial life insurance policy on her husband before his death. They claim she spiked his drink with a lethal dose of fentanyl in an attempt to kill him. Richins has also been charged with attempted murder for allegedly drugging her husband’s Valentine’s Day sandwich in a separate incident. Additional charges against her include forgery and fraud related to mortgage and insurance. Richins has not entered a plea, and she and her family continue to maintain her innocence.
