STF begins to judge decision on substitute for Deltan Dallagnol in Câmara

The Federal Supreme Court (STF) begins this sixth fair (9) the ruling on the substitute of Deltan Dallagnol (Podemos-PR) in the Chamber of Deputies.

The virtual plenary was opened at 0h of this sixth session and the ministers can cast their votes at 23:59. Because it is a virtual plenary, the ministers do not need to debate the topic and only cast their votes in the electronic system.

The decision will be based on the decision of minister Dias Toffoli, who monocratically determined that the Dallagnol area should be occupied by Luiz Carlos Hauly (Podemos-PR). Toffoli’s decision changed the understanding of the Paraná Regional Election Court (TRE-PR), which had graduated Itamar Paim (PL-PR).

“The preservation of the challenged decision undermines the proportional system, or adjusts the representativeness of the legend, whose candidate has or request for indeferred candidacy after election”, justified Toffoli in the preliminary.

Dallagnol had the mandate of a federal deputy married by the Superior Eleitoral Court (TSE) on May 16, after the court understood that the former Lava Jato prosecutor had anticipated his exoneration to escape punishment and not be included in the Clean Ficha Law .

The TSE used as a basis for the appeal the excerpt from the Law of the Clean File that prohibits magistrates and members of the Public Prosecutor’s Office from requesting exemption to dispute elections if they have pending administrative processes.

The ministers will understand that Dallagnol disassociated himself from the Federal Public Prosecutor’s Office one year before the election, anticipating that the disciplinary procedures to which he responded could place his future candidacy at risk.

The board of directors of the Chamber of Deputies recognized in third (6) the decision of the Electoral Justice and published the murder of Dallagnol. The married deputy said that the decision for the marriage of his mandate was “against the will of the people” and promised to “fight até or fin”.

Former coordinator of the Lava Jato task force in Paraná, Dallagnol was elected or the most voted representative of Paraná in the 2022 elections, with 344,917 votes.
