The Attorney General of the Republic (PGR) asked the Federal Supreme Court (STF) to annul the decision that sentenced the married federal deputy Deltan Dallagnol (Podemos-PR) to indemnify President Luiz Inácio Lula da Silva (PT) in R$ 75 A thousand hairs case that was known as “PowerPoint da Lava Jato“.
The Supreme Court will judge an appeal by Dallagnol and the National Association of Attorneys of the Republic against the decision of the Superior Court of Justice (STJ) that ordered the payment of compensation for moral damages.
The PGR understands that the decision of the STJ to fine Dallagnol goes against a decision of general repercussions already established by the STF. The decisions with general repercussions refer to the extraordinary resources that have never been judged and have never had their fixed rates, and their decision can be attributed to similar processes.
“Condemning the payment of indemnity for moral damages, doing it in a sense diametrically opposed to what was established at the headquarters of general repercussions by the Federal Supreme Court,” he argues to PGR
In 2016, Dallagnol, the coordinator of Lava Jato, put together a PowerPoint presentation to illustrate the accusation against Lula, the main person under investigation for the operation.
At the time, Lula’s lawyer, Cristiano Zanin, questioned the conduct of the former attorney, stating that Dallagnol had used his representation to accuse the current president of commanding a criminal organization.
This week, Minister Cármen Lúcia, of the Supreme Court, objected to a request to annul the decision of the STJ, which established a fine for moral damages in March 2022. The objection occurred for procedural reasons, even if the merit of the request has been further analyzed .
