Apology requests do not lighten the crime, says lawyer and ex-BBB Gizelly Bicalho

The crime of sexual harassment became the issue of the moment after the case involving the Mexican model Dania Mendez in Big Brother Brazil (BBB 23), from TV Globo.

Globo decided to expel the participants MC Guimê and Antonio “Cara de Sapato”, at the fifth fair (16), after the Jacarepaguá Women’s Care Delegation opened an inquest to investigate sexual harassment inside the house.

The wrestler “Cara de Sapato” published, on this Saturday (18), a video on his social networks in which he says that “he did not perceive” that he could be crossing two limits and apologized for the episode involving Dania Mendez. Guilherme Dantas, known as MC Guimê, published a video on his social networks at the sixth fair (17) in which he asked “apologies to Dania, to Lexa, to Bruna, and to all the women who in some way felt offended.”

In interview with CNN This Sunday (19), criminal lawyer and ex-BBB Gizelly Bicalho commented on the episode and the possible punishments for the crime of sexual harassment.

“They go to me to ask for an apology, it is not threatening the crime, it is showing their responsibility. ‘Olha, eu fiz, vou assumir, vai ter um proceso e eu vou respondar’. They are not coitadinhos, they have an attitude, excuse the word for a bit more cool, but since a puppy is fossed, I don’t go above the participant”, affirms Gizelly.

According to the lawyer, the penalty for the crime of sexual harassment in Brazil is from 1 to 5 years in prison.

“For example, você está num carnaval, or cara vem e rouba um beijo. There is no stolen baby, it is sexual harassment. When, for example, the face masturbates on his forehead, ejaculates or exhibits the penis, throws clothes in front of someone, tries to force himself, rubs someone with the intention of satiating or desire is considered sexual harassment. A penalty dese crime is from 1 to 5 years, ”explains a specialist.

“Last year, 30 million women were victims of some kind of sexual assault or sexual importunation – 15% of the Brazilian population. These are the cases that have been reported, but they will not be reported”, highlighted Gizelly.
