The teenager who, in 2018, attacked a classmate from the secondary school of Cucujães, leaving him with a physical disability of more than 80% and with serious neurological sequelae, declared to the Court of Feira, this Tuesday morning, that he was sorry “for all life”.
The facts date back to 30 November 2018, around 8.40 am, and took place next to the bus stop located in front of Escola Secundária Dr. Ferreira da Silva, in Cucujães, in the municipality of Oliveira de Azeméis.
According to the accusation of the Public Prosecutor’s Office (MP), the defendant Filipe Silva, at the time aged 17, and André Filipe Sousa Martins, of the same age, got involved in a discussion and in mutual aggressions. “He came up to me and pushed me”, justified the defendant, who is accused of having punched and kicked the head and other parts of the schoolmate’s body.
Before the judges, Filipe Silva only confirmed that he punched twice, one on each side of the face, denying aggression to the head or neck. He added that they broke up when a student’s father yelled for them to stop.
Afterwards, “André asked if that was all he had to give him [a agressão] and he fell”, recalled the defendant, who left the student prostrate on the floor and went to the classroom.
“If I had known the state he was in, I would have provided assistance”, now guarantees Filipe Silva, who said it was “horrible to know the state he was in”. “To this day I carry that weight”.
The defendant also confirmed that he had a school background marked by other disputes with colleagues and that he was being followed by a psychologist.
One of the defendant’s colleagues, a witness in the process, stated that both the accused and the victim were already “stuck”. He recalled that, when he was at the stop with Filipe Silva, André Martins arrived on the bus. At that time, the defendant and André Martins exchanged “gestures with the middle finger”, said the witness.
“André jumped out of the bus, threw his backpack on the ground and went towards Filipe. The two of them grabbed each other”, explained the witness. She further said that both inflicted assaults on each other’s head area.
According to the MP, as a result of this fight, the victim was staggered, unable to walk, and fell to the ground, initially still conscious. Afterwards, he lost consciousness, recovered and became inanimate again, with a red bruise on his forehead on the right side.
Also according to the prosecution, despite seeing that André Martins was not feeling well, the accused ended up leaving the place next to the bus stop and headed inside the School. The victim was left to his own devices, and he did not provide any assistance. It was other people calling for help.
Depressed with difficulty walking
André was rescued by the Firemen, who transported him to the Hospital of Santa Maria da Feira. Later, he would be transferred to the Centro Hospitalar de Vila Nova de Gaia, due to the seriousness of his health, where he arrived in a comatose state.
The MP says that André Martins suffered traumatic brain and cervical trauma, followed by a left carotid stroke (cerebrovascular accident) with occlusion of the middle cerebral artery and restriction of flow in the anterior cerebral artery
As a result of the physical aggression perpetrated by the defendant, the victim had consolidated neurological sequelae.
In May 2019, André Martins was awarded a medical certificate of multipurpose disability, which gave him 87% disability.
Speaking to JN, the victim’s father, Marcos Martins, said that his son is currently in a state of depression due to his physical condition. He is conscious, but with severe complications in locomotion, managing to move upright with great difficulty. He also has speech difficulties. Reason why he has been undergoing consecutive treatments, trying to minimize the injuries that “will remain for life”.
