The story of Nela Pogrebytska shook the country three years ago, when the girl was raped in the Kagarlyk police station. All this time, court hearings continued, and now two of the five suspects remain.
Over the years of the case, Nelya has survived dozens of interrogations and hearings, her lawyer says. The trial was closed from journalists, which is a pity, says Olena Sotnyk, because everyone should have seen the audacity of the former cops.
The lawyer of one of the suspects reacts aggressively to the journalists’ attention to the case before the decisive meeting. Once he himself was in the place of his client – being a law enforcement officer, he was tried for rape.
The proceedings against Nelaya have been going on since May 2020. She was called to the Kagarlyk police station as a witness, and there, before being raped, they abused her with a gas mask and a gun. “He would point to the knee, then he would point to the bullets, he would say, you see, I will shoot you now,” the girl said.
Five suspects were on the dock: Mykola Kuziv – the former head of the criminal police sector of Kagarlyk, and Serhiy Sulyma – the operational commissioner of the criminal police sector – were immediately taken into custody. The Obukhiv district court of the Kyiv region sentenced them to eleven years behind bars. They have already served three of them.
The proceedings against three more suspected ex-policemen: Yaroslav Levandyuk, Serhiy Panesenko, and Yevhen TrokhImenko were suspended. One of them joined the army at the beginning of the war, and two were mobilized two weeks before the verdict was announced. “This happened during the trial, at which court debates were scheduled. A few weeks ago – a month”, – says the prosecutor.
Each of them could spend eight years behind bars. “This is not the first such case for me, when the proceedings are suspended due to mobilization. This is such a dilemma, and on the other hand, we also understand that mobilization is different, there are guys in Bakhmut, but we don’t know where they are, maybe the war will end in the fall, and they will never go to the front,” he says. the victim’s lawyer.
Formally, these men did not break the law, says one of the suspect’s lawyers. “In connection with the changes to the Criminal Procedure Code, with the martial law, a rule of law was introduced, where a case is separated into a separate proceeding if it was mobilized to the armed forces and suspended,” he explains.
But it is not a fact that the proceedings will be resumed after the war, according to the public organization “Legal Hundred”. Some of the accused Ukrainians are already taking advantage of this opportunity.
Ex-policemen who were mobilized are suspected of kidnapping, torture and failure to take appropriate measures to stop the torture. According to the law, consideration of their cases should be renewed after dismissal from service. All five suspects did not admit their guilt. And the defense of Sulima and Kuziv, who were given 11 years in prison each, will file an appeal.
